Please be advised that it is the policy of William G. Schwab, Trustee and the Office of the United States Trustee not to continue any 341 meetings.

If the individual does not appear when the case is called, it will automatically be rescheduled to the next month at the beginning of the list.

You do not have to call my office to obtain a rescheduling, however, we do appreciate being alerted to cases in which the parties are not expected to appear.

Under the Northern Tier Practice Order of the Middle District, any rescheduled 341 meeting necessitated the attorney to notice the creditors of the rescheduled date. After the case is called, the Trustee will provide the attorney with the form notice and the date and time of the rescheduled 341 meeting.

In the event the person does not appear at the rescheduled 341 meeting, the Trustee is under direction to file a Motion to Dismiss for failure to appear.
